Rutinea Terms & Conditions.

These Terms & Conditions (“Terms”) apply to your use of Rutinea and to any subscription you purchase from us.

Please read them before subscribing.

1. About Rutinea

Rutinea is operated by Rutinea Ltd, a company registered in Scotland under company number SC895327, with its registered office at 60 Constitution Street, Leith, Edinburgh, Scotland, EH6 6RR.

Rutinea is the trading name of Rutinea Ltd.

Rutinea is an online Spanish-learning service providing guided learning routines, level assessment, learning content, practice activities, progress tracking and related digital tools (the “Service”).

You must be 18 or over to create an account or use Rutinea.

These Terms apply to customers using Rutinea for personal, non-commercial purposes.

 

2. The Rutinea service

Rutinea is a digital subscription service.

Your subscription gives you access to the content and features included in your plan while you are entitled to use the Service. You are not purchasing individual courses or permanent ownership of Rutinea content.

We may update, improve, replace or modify content, exercises, features, interfaces and other elements of the Service as Rutinea develops.

 

3. Your account

You must provide accurate and up-to-date information when creating and using your account.

Your account and subscription are personal to you. You must not share your login details, allow another person to use your subscription, or create multiple accounts to circumvent trial or promotional restrictions.

You are responsible for keeping your login credentials secure and your contact details up to date.

If you believe your account has been accessed without your permission, please contact support@rutinea.com.

 

4. Plans, Pricing and Promotions

The subscription plan, price, billing period and any specific conditions applying to your purchase will be shown before you subscribe.

The price displayed at checkout is the total price you will pay, including any applicable taxes.

Rutinea may change prices for new subscriptions at any time.

We may also offer promotional, introductory or discounted plans. Any specific conditions applying to an offer, including its price, duration and eligibility requirements, will be shown before purchase.

If the specific conditions of an offer differ from these general Terms, the specific conditions will apply to that offer.

 

5. 7-Day free trial 

Where offered, your subscription will begin with a 7-day free trial.

You must select a subscription and provide a valid payment method when starting the trial.

Unless you cancel before the trial ends, your selected paid subscription will start automatically when the trial finishes and your payment method will be charged the price shown at checkout.

If you cancel during the free trial, you will not be charged the first subscription payment.

A free trial is available once per customer, unless Rutinea expressly offers otherwise. We may refuse or withdraw trial eligibility in cases of fraud, abuse or attempts to circumvent this restriction.

 

6. Subscriptions and automatic renewal

Subscriptions renew automatically until cancelled.

Monthly subscriptions renew monthly and annual subscriptions renew annually.

The applicable price, billing frequency and first payment date will be shown before you subscribe.

To avoid the next renewal charge, you must cancel your subscription before that renewal is processed.

Cancellation prevents future renewals but does not normally end access immediately. Unless a refund or other legal right applies, you will retain access until the end of the period already paid for.

After subscribing, we will provide confirmation of your subscription electronically.

Rutinea will provide any subscription or renewal notices required by applicable law.

 

7. Founder price 

The Rutinea Founder subscription is a monthly subscription priced at £8.99 per month following any applicable free trial.

The Founder Price will remain £8.99 per month for as long as the qualifying subscription remains continuously active.

A temporary payment failure will not, by itself, cause you to lose your Founder Price if the subscription is successfully recovered before it is cancelled.

If your Founder subscription is cancelled or otherwise ends, your entitlement to the Founder Price ends with it. Any later subscription will be subject to the price and conditions available at that time unless Rutinea expressly offers otherwise.

The Founder Price is personal, non-transferable and applies only to the Founder monthly subscription.

 

8. Cancellation and 14-day money-back guarantee

You may cancel your subscription at any time to prevent future renewals.

Unless a refund or statutory right applies, cancellation takes effect at the end of the period already paid for. We do not provide pro-rata refunds for unused subscription time.

Rutinea also provides a 14-Day Money-Back Guarantee on the first paid subscription charge following your free trial.

To claim under this guarantee, you must email support@rutinea.com within 14 calendar days of that first charge.

If your request qualifies, we will refund 100% of that first subscription payment, normally to the original payment method, and your access to Rutinea will end.

The guarantee applies only to the first payment of a new qualifying subscription and does not automatically apply again if you cancel and later resubscribe.

This guarantee is separate from any statutory cancellation, refund or other consumer rights you may have.

 

9. Payments and failed payments

Payments are processed through Kajabi Payments or another payment service provider made available by Rutinea.

Rutinea does not store complete payment-card details where these are processed directly by the payment provider.

If a recurring payment fails, we or our payment provider may retry the payment or ask you to update your payment method.

Access to some or all of the Service may be restricted or suspended while payment remains outstanding.

If payment cannot be recovered, your subscription may be cancelled.

 

10. Changes to Prices and the Service

Changes to prices for new subscriptions do not affect subscription periods already purchased.

For an existing standard subscription, Rutinea may change the price applying to a future renewal. Where appropriate, we will give reasonable advance notice so that you can cancel before the new price takes effect.

The price of an annual subscription will not change during an annual period already paid for.

The Founder Price is governed by section 7.

Rutinea may reasonably update or change its content, features, technology and structure as the Service develops.

If a change materially reduces the core Service available under an active subscription, we will provide appropriate notice and respect any rights available to you under applicable consumer law.

11. Acceptable Use and Intellectual Property

Rutinea and its content are provided for your personal, non-commercial use.

You must not:

• share your account or subscription with another person;

• copy, reproduce or redistribute substantial parts of Rutinea content;

• scrape, systematically extract or bulk-download Rutinea content or data;

• bypass security or access restrictions, or attempt to access areas or data you are not authorised to use;

• reverse engineer, interfere with or manipulate the Service except where permitted by law; or

• use Rutinea fraudulently or unlawfully, or systematically extract or reuse Rutinea materials to create or develop a competing product or service.

All intellectual property rights in Rutinea, including its exercises, question banks, texts, audio, video, explanations, learning materials, routines, software, interfaces, databases, branding and design, belong to Rutinea Ltd or the relevant third-party rights holder.

We grant you a limited, personal, non-exclusive and non-transferable licence to use Rutinea while you are entitled to access the Service.

If Rutinea makes materials available for download, you may use those materials only for your personal, non-commercial use unless we expressly state otherwise.

12. Availability, Learning Outcomes, Suspension and Liability

We aim to keep Rutinea available and operating reliably, but we cannot guarantee uninterrupted or error-free access. Maintenance, updates, technical problems or circumstances outside our reasonable control may occasionally affect availability.

Rutinea provides tools and resources to support Spanish learning. We do not guarantee that you will achieve a particular level, pass an examination or obtain any particular academic, professional or learning outcome.

We may temporarily suspend access where reasonably necessary because of security concerns, suspected fraud, payment problems or a material breach of these Terms.

Where appropriate, we will give you an opportunity to resolve the issue before terminating your subscription. Serious fraud, deliberate unauthorised access, significant security abuse or systematic misuse of Rutinea content may result in immediate termination.

Rutinea may stop offering a plan to new customers without automatically ending existing subscriptions.

If Rutinea permanently stops providing the Service and cannot provide a period for which you have already paid, we will provide any refund or other remedy required by law and, where appropriate, refund the unused prepaid period.

Nothing in these Terms excludes or limits any rights, remedies or liabilities that cannot lawfully be excluded or limited. Your statutory consumer rights remain unaffected.

13. Privacy, Third-Party Services and Changes to these Terms

Our Privacy Policy explains how Rutinea Ltd collects, uses and protects your personal data.

Rutinea may use third-party providers for payments, hosting, infrastructure, communications, analytics and other services required to operate the Service.

Some links or services may lead to independent third-party websites with their own terms and privacy policies.

We may update these Terms for reasonable reasons, including changes in law, regulation, security requirements, technology or the operation of Rutinea.

Minor or administrative changes may take effect when published.

If a change materially affects your rights or obligations under an active subscription, we will provide reasonable advance notice where appropriate.

Changes will not retrospectively alter a subscription period already paid for or override the Founder Price protection in section 7.

14. Governing Law, General Terms and Contact

These Terms are governed by the laws of Scotland.

If you are a consumer, this choice of law does not remove any mandatory consumer protections that apply to you under the laws of the country in which you live, or prevent you from bringing proceedings before a court that has jurisdiction under applicable law.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

If Rutinea does not enforce a provision immediately, this does not mean that we waive our right to enforce it later.

You may not transfer your subscription or your rights under these Terms to another person without our consent.

Rutinea may transfer its rights and obligations in connection with a sale, transfer or reorganisation of its business, provided that this does not materially reduce your consumer rights.

These Terms, together with the specific conditions shown when you purchase your subscription, form the agreement governing your paid use of Rutinea.

These Terms are written in UK English. If translations are made available, the English version will prevail in the event of any inconsistency unless applicable law requires otherwise.
